Announcing the Decision to Implement Export Controls on Certain Items Related to Medium and Heavy Rare Earths

In accordance with the relevant provisions of the Export Control Law of the People’s Republic of China, the Foreign Trade Law of the People’s Republic of China, the Customs Law of the People’s Republic of China, and the Regulations of the People’s Republic of China on the Export Control of Dual-Use Items, and for the purposes of safeguarding national security and interests and fulfilling international obligations such as non-proliferation, a decision has been made, with the approval of the State Council, to implement export controls on the following items:
I. 1C909 Items related to Holmium
(A) 1C909.a. Holmium metal, holmium-containing alloys, and related products:
1. Holmium metal
(Reference Customs Tariff No.: 28053019).
2. Holmium-containing alloys:
a. Holmium-copper alloys;
b. Magnesium-holmium alloys;
c. Holmium-iron alloys.

Notes:
1. The alloys controlled under items 1C909.a.2, 1C910.a.2, and 1C912.a.2 include forms such as ingots, blocks, bars, wires, sheets, rods, plates, tubes, granules, and powders.
2. The sputtering targets controlled under items 1C909.a.3, 1C910.a.3, 1C911.a.2, 1C912.a.3, and 1C913.a.2 include forms such as sheets and tubes.
3. The permanent magnet materials controlled under item 1C909.a.4 include magnets or magnetic powders.
4. The oxides, compounds, and their mixtures controlled under items 1C909, 1C910, 1C911, 1C912, and 1C913 include, but are not limited to, forms such as powders.
Exporters of the aforementioned items shall apply for a license from the competent commerce department of the State Council in accordance with the relevant provisions of the Export Control Law of the People’s Republic of China and the Regulations of the People’s Republic of China on the Export Control of Dual-Use Items.
Exporters shall be responsible for the authenticity of the declared goods and shall enhance the identification of exported items. For items subject to control, “is a dual-use item” must be noted in the remarks column of the customs declaration form, along with the dual-use item export control code. For items that are not subject to control but have parameters, specifications, or performance characteristics approaching those of controlled items, “is not a controlled item” must be noted in the remarks column of the customs declaration form, along with the specific parameters and specifications. If there are doubts regarding the completeness, accuracy, or authenticity of the above-declared information, Customs will raise questions in accordance with the law, and the export goods will not be released during the period of inquiry.
This announcement shall be formally implemented starting November 8, 2025. The Dual-Use Items and Technologies Export Control List of the People’s Republic of China will be updated simultaneously.
